Waiver and Release Form:

I release   Zenergy   Yoga,   Loraine   Rushton,  and Zenergy Yoga facilitators, employees, assistants and staff from responsibility for any injuries I may receive as a result of my participation in this course. I certify that my level of physical condition as determined by myself or my physician will allow me to safely participate in this program.

I understand that Yoga is not a substitute for medical attention, examination, diagnosis or treatment. Yoga is not recommended and is not safe under certain medical conditions. By signing, I affirm that a licensed physician has verified my good health and physical condition to participate in such a yoga program, if required. In addition, I will make the instructor aware of any medical conditions or physical limitations before the course. If I am pregnant, become pregnant or I am post-natal or post-surgical, my signature verifies that I have my physician’s approval to participate. I also affirm that I alone am responsible to decide whether to practice yoga and participation is at my own risk. I hereby agree to irrevocably release and waive any claims that I have now or may have hereafter against Zenergy Yoga for any personal injury or negligence. Additionally, the instructor(s) and Zenergy Yoga are not in any way responsible for any loss or damage of your personal property.

I understand that I will receive a certificate upon completion of the course. I understand that if I miss more than 30 minutes of a live or virtual training course I will not receive a certificate of completion. If I require a makeup session, I understand that it will be charged at a rate of $150 per hour.

Though Zenergy endeavours to emphasise the importance of integrity and ethics in children’s yoga teachers, I agree that Zenergy is not responsible for the actions of those who have taken training in this course.

I understand that all concepts, information and materials in this course (the “Materials”) are the property of Zenergy and are commercial-in-confidence. They are protected by copyright, trade secret, and other applicable laws. I acknowledge that the Materials constitute commercially valuable, proprietary, confidential property of Zenergy, the design and development of which required the investment of substantial effort, time, and money and reflect, in part, the credibility and “good will” of Zenergy. I agree that what I learn in the Zenergy courses and the materials I receive are only to be used by me when teaching yoga classes to children. I acknowledge and agree that I have no right to modify, edit, alter or enhance any of the Materials in any manner, other than when teaching a class to children. The Materials may not be duplicated, distributed, transmitted, or broadcast in any manner, or used for any purpose, without the prior written permission of Zenergy.  I  agree that I will not use the Materials in any way that might compromise the proprietary or confidential nature of the Materials. Without limiting any of the foregoing, I agree not to deliver the Materials themselves, either reproduced or modified, or anything derived from the Materials, either orally or in writing, as part of any professional development session, seminar, training program, workshop, website, book, ebook, consulting, or other business activity, except with the prior written permission of Zenergy, which may be given on such terms as it deems fit. Furthermore, I will not pass off the content, concepts or information in the Materials as my own.

I understand photographs, video, and/or audio recordings may be taken during the training courses. I irrevocably consent to and authorise the use, publication and reproduction of these photographs or recordings, for any editorial purpose, television, promotion, art, advertising or other purpose whatsoever. I understand that there will be no financial or other remuneration for either the initial or subsequent use of these photos/videos or audio and consent to being photographed and/or recorded.

I agree that I will not record the training course in any way without the express prior written consent of Loraine Rushton.

All Zenergy Yoga Online classes, online courses, and products purchased are non-refundable and non-transferable. For all live and in person courses, deposits are refundable for up to 10 days after registration, after which time they are no longer refundable and only transferable to another course. Course transfers must be completed within one year of the original course date. All Refunds or transfers will incur a $50 processing fee. Course registrations are not transferable to a different course or another person. No refunds or transfers will be issued within 30 days of the in-person training courses.

I have read and understood this release and am legally competent to agree to it.

By agreeing to the terms upon registration into the Zenergy Yoga course, I hereby agree to and will abide by the terms of this waiver, release and agreement.
